On May 21, 2001, the House of Representatives passed a four-month temporary
extension of the Section 245(i) deadline (H.R. 1885). The Legal Immigrant
Family Equity Act (LIFE) restored Section 245(i), which expired in 1998, for
four months, until April 30, 2001. Many individuals were unable to file a
petition for a variety of reasons. H.R. 1885 provides a four month
extension and requires beneficiaries to demonstrate that the required
“familial or employment relationship” existed on or before April 30, 2001.
The short extension and the additional requirement, will require the
Immigration and Naturalization Service to write additional regulations, and
will leave many potential beneficiaries unable to apply.
In contrast, a bill introduced in the Senate (S. 778) by Senators Chuck
Hagel (R-NE) and Edward Kennedy (D-MA) would extend Section 245(i) for one
year and does not include the restriction of requiring a relationship
existing before April 30, 2001. There are 22 cosponsors: Senators Jeff
Bingaman (D-NM), Barbara Boxer (D-CA), Lincoln Chafee (R-RI), Hillary Rodham
Clinton (D-NY), Jon Corzine (D-NJ), Tom Daschle (D-SD), Christopher Dodd
(D-CT), Pete Domenici (R-NM), Richard Durbin (D-IL), John Ensign (R-NV),
Peter Fitzgerald (R-IL), Charles Grassley (R-IA), Jesse Helms (R-NC), John
Kerry (D-MA), Richard Lugar (R-IN), Barbara Mikulski (D-MD), Benjamin Nelson
(D-NE), Jack Reed (D-RI), Harry Reid (D-NV), Charles Schumer (D-NY), and
Paul Wellstone (D-MN).
S. 778 is a priority of the Senate Judiciary Committee and a “mark up” is
tentatively set in the Judiciary Committee for Thursday, June 14th. With
the possibility of movement of this bill next week, it is important to
contact your Senator and pressure him/her to cosponsor and support this
one-year extension of Section 245(i).
Attached are materials prepared by the National Immigration Forum and the
American Immigration Lawyers Association. The first document is talking
points on H.R. 1885 and S. 778. This briefly describes the two bills and
gives reasons to support S. 778 and why H.R. 1885 is not enough. The second
document is an Editorial Boards and Leaders Quotes Page. It is a collection
of quotes from different editorial boards and leaders advocating for a
deadline extension that would ensure fairness to families and workers who
were eligible for the LIFE Act’s extension, but were unable to file their
applications in time.
