[LearningDisabilities 1630] LD Documentation Time Limits

Hello All:

Recently the literacy agency that I work for instituted an LD policy that included the stipulation that a student's documentation of his or her learning disability has to be no more than five years old. I was also told that the college were teach a Pre-GED class has the same stipulation.

I was under the impression, perhaps in my own little mind, that this question had been raised in court cases involving the ADA and that court rulings had established that such a stipulation was not valid because a learning disability is a permanent disability that is present throughout an individual's entire lifetime, and, therefore, once is has been professionally diagnosed, there is no need to continually redocument its existence.

Does anyone know if this is the case?
