Dear Katherine,



Here's what I would do in the case of an individual who has received a
federal loan without knowledge of having a LD. I would have the student
or assist the student in contacting the American Student Assistance
(ASA) Office about the Forgiveness Loan Program. The student will have
to get a letter from the psychologist that administered the
testing/evaluation. Make sure the psychologist includes the student's
diagnosis and that he/she wasn't aware of having a LD. There is also a
"forgiveness" form that the student will have to complete. Once the
"forgiveness" form and letter are completed send them to ASA.



The ASA may forgive the loan or at least a portion of it. It's worth a
try because the student's creditworthiness is at stake too. An
unfavorable credit report could unfortunately prevent him/her from
getting a personal loan and in some cases employment. Good luck!

I realize receiving financial aid isn't a protected status. But what
about people who have disabilities who have received financial aid or
who have borrowed money, only to fail because of an undiagnosed
disability?

I do not believe it is a civil rights violation to omit
screening anyone receiving college Federal Financial Aid, particularly,
including those students who have failed in a higher education system.
The "receipt of financial aid" is not a protected classification under
Federal or state civil rights laws.
