Hello,
I am posting the response to Katherine's message from Idris Muhammad.
If an institution restricts disabled students that are receiving financial
aid from the provision of testing but offers it to similarly situated
non-disabled students, then the institution has violated anti-discrimination law.
However, keep in mind, the provision of psychoeducational testing to students is
not a reasonable accommodation required under Section 504 or the ADA.
Respectfully yours,
Idris A. Muhammad, Director

Thanks,

I realize receiving financial aid isn't a protected status. But what about
people who have disabilities who have received financial aid or who have
borrowed money, only to fail because of an undiagnosed disability?

I do not believe it is a civil rights violation to omit screening anyone
receiving college Federal Financial Aid, particularly, including those students
who have failed in a higher education system. The "receipt of financial aid"
is not a protected classification under Federal or state civil rights laws.
