[LearningDisabilities 1653] Re: Fwd: Answer to Jon's Question - LDDocumentation Time LimitsKatherine kgotthardt at comcast.netFri Jan 18 22:10:53 EST 2008
I would like to thank everyone in this forum for posting answers to my question. Because I am in the situation I described but have been unsuccessful at convincing ANYONE in any agency that these loans should be discharged and that the school DOES hold some responsibility, I decided to post the issue here to see what professionals in the field think. Per usual, there is a discrepancy between the expertise voiced in these forums and the agencies' purely bureaucratic, self-interested dismissals I've been confronting for years. And we know I am not the only student who has had to endure this. Much appreciation for your insight. If an institution restricts disabled students that are receiving financial aid from the provision of testing but offers it to similarly situated non-disabled students, then the institution has violated anti-discrimination law. However, keep in mind, the provision of psychoeducational testing to students is not a reasonable accommodation required under Section 504 or the ADA. Respectfully yours, Idris A. Muhammad, Director Student Disability Services (386) 506-3076 muhammi at dbcc.edu Thanks, Rochelle Rochelle Kenyon Moderator, NIFL/LINCS Learning Disabilities Discussion List Center for Literacy Studies at the University of Tennessee RKenyon721 at aol.com To post a message: Learningdisabilities at nifl.gov To subscribe: http://www.nifl.gov/mailman/listinfo/LearningDisabilities To read archived messages: http://www.nifl.gov/pipermail/learningdisabilities/2008/date.html I realize receiving financial aid isn't a protected status. But what about people who have disabilities who have received financial aid or who have borrowed money, only to fail because of an undiagnosed disability? Katherine Mercurio Gotthardt www.luxuriouschoices.net I do not believe it is a civil rights violation to omit screening anyone receiving college Federal Financial Aid, particularly, including those students who have failed in a higher education system. The "receipt of financial aid" is not a protected classification under Federal or state civil rights laws. Respectfully yours, Idris A.
